General Terms and Conditions of Sale
These General Terms and Conditions of Sale govern the distance purchase of products sold on www.bodynutrition.biz by consumers and business customers. For any matter not expressly provided for herein, the applicable Italian legislation shall apply, and in particular Legislative Decree no. 206/2005 (“Consumer Code”) for consumers.

2. Products and essential characteristics
The essential characteristics of the products are described in the relevant product sheets published on the website. Images are for illustrative purposes only and may not perfectly represent the product. All prices are expressed in Euro and, unless otherwise stated, are inclusive of VAT.
3. Prices, availability and validity of offers
The prices and offers published on the website remain valid until modified or updated. Any price changes shall not apply to orders already confirmed. Product availability is indicated on the website but may change even after the order has been placed.
4. Contract conclusion procedure
To place an order, the customer must follow the procedure indicated on the website, adding products to the cart, entering the required data and confirming the order. Sending the order constitutes a purchase proposal. The contract is concluded when the seller sends the customer an order confirmation or shipping confirmation email.
5. Product availability
If one or more products become partially or totally unavailable after the order has been placed, the customer will be informed promptly. In such case, the seller may propose an amendment to the order, waiting for restocking, or refunding the amount related to the unavailable products.
6. Minimum order amount
The minimum order amount is €25.00.
7. Payment methods
The customer may choose, where available, among the following payment methods:
- advance bank transfer;
- credit/debit card through the payment circuits and providers available on the website;
- PayPal;
- any other payment methods indicated during checkout.
Payments are handled through secure connections and by the payment providers indicated on the website.
8. Shipping and delivery
Shipping costs are indicated during checkout before the order is confirmed. The seller ships to Italy and to the European countries indicated on the website through selected couriers, such as UPS or DHL, depending on destination, weight and available logistics.
Unless otherwise provided due to unforeseen events or force majeure, delivery generally takes place within 48/72 working hours for available products, and in any case within the maximum timeframe indicated during the order process.
Upon delivery, the customer is required to check the integrity of the package and the correspondence of the number of parcels. Any visible anomalies must be immediately reported to the courier by adding a specific reservation on the delivery document.
9. Failed delivery, storage and incorrect shipping details
The customer must provide complete and correct shipping details and be available for delivery. In the event of failed delivery due to the recipient’s absence, incorrect or incomplete address, failure to collect from the storage point, or any other reason attributable to the customer, any storage, return and reshipping costs may be charged to the customer in the actual amount incurred by the seller.
10. Consumer right of withdrawal
Under Legislative Decree no. 206/2005, the consumer has the right to withdraw from the purchase, without giving any reason, within 14 days from the date on which the consumer or a third party designated by the consumer, other than the carrier, acquires physical possession of the goods.
To exercise the right of withdrawal, the consumer must send an explicit notice within this period through the contact form available on the website.
The notice must include at least:
- first and last name;
- order number;
- products for which withdrawal is requested;
- customer’s contact details.
After notifying the withdrawal, the consumer must return the goods within 14 days to the following address:

Return shipping costs are borne by the consumer, unless otherwise indicated by the seller.
The seller will refund all payments received from the consumer, including any standard delivery costs paid, within 14 days from receipt of the withdrawal notice. The refund may be withheld until the goods are received back or until the consumer provides proof of having sent back the goods.
The refund will be made using the same payment method used by the consumer for the initial transaction, unless otherwise agreed.
11. Exclusions from the right of withdrawal
The right of withdrawal is excluded in the cases provided for by Article 59 of the Consumer Code. In particular, the right of withdrawal does not apply to sealed goods which are not suitable for return for hygiene or health protection reasons and have been unsealed after delivery.
12. Condition of returned goods
The consumer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods. Products must be returned, where possible, complete with their original packaging and adequately packed for transport.
13. Legal guarantee of conformity
For consumer customers, the legal guarantee of conformity provided for by Articles 128 et seq. of the Consumer Code shall apply. In the event of a lack of conformity, the consumer is entitled to the remedies provided by law.

15. Invoicing
The customer may request an invoice in the cases and according to the procedures provided for by the applicable tax regulations. The tax document will be issued based on the data entered by the customer during the order process. The customer is responsible for the accuracy of the billing details provided.

17. Applicable law and jurisdiction
These General Terms and Conditions of Sale are governed by Italian law.
- If the customer is a consumer, any dispute shall be subject to the jurisdiction of the court of the consumer’s place of residence or domicile, if located in Italy.
- If the customer purchases in the course of business, trade, craft or professional activity, any dispute shall fall under the exclusive jurisdiction of the Court of Trani.
